GENERAL TERMS AND CONDITIONS OF USE
TERMS OF USE OF THE OUTFITS® WEBSITE
Preamble
The Outfits® website (hereinafter "the Website") is a digital platform at the convergence of music, fashion and e-commerce. It enables users to purchase directly, through an immersive vertical video interface, the clothing and accessories worn by artists in their music videos.
Access to the Website implies unreserved acceptance of these Terms of Use ("ToU").
Outfits® is an innovative platform whose immersive user experience, UX architecture and all graphical user interfaces are protected by French, European and American intellectual property law.
Article 1: Purpose
These Terms of Use define the conditions under which any user (hereinafter "the User") may use the Website.
Article 2: Intellectual Property
2.1. Platform Ownership
The Website and each of its constituent elements (UX architecture, design, layout, functional structure, texts, graphical user interfaces, navigation, interaction protocols, animations) are the exclusive property of Nancy-Hélène Gibon (hereinafter "the Founder") and are protected by all applicable intellectual property rights.
Outfits® is a registered trademark with the INPI (French National Institute of Industrial Property) (classes 9, 25, 35, 38 and 41), including the logo. Class 25 (clothing) has been active since September 2023.
The Founder holds the following comprehensive intellectual property rights:
— 35 registered designs filed with the European Union Intellectual Property Office (EUIPO), under Locarno Classification 14-04 "Graphical User Interfaces [screen displays]" (application Nos. 015119356, 015126523, 015132666);
— 26 designs filed with the INPI (French National Institute of Industrial Property), documenting the progressive evolution of the interface;
— 29 copyright registrations in France (Copyright France, SGDL, Copyright Dépôt);
— 3 copyrights registered with the United States Copyright Office;
— 13 e-Soleau deposits with the INPI, representing over 280 pages of detailed documentation including User Flows, CTA specifications and platform architecture;
— A DMCA (Digital Millennium Copyright Act) protection framework ensuring international content protection.
The project's prior art is established and proven since December 9, 2021.
2.2. UX Architecture and Protected Elements
The overall architecture of Outfits® constitutes an original creation protected by the French Intellectual Property Code (articles L.111-1 et seq.), Council Regulation (EC) No 6/2002 on Community Designs, and the U.S. Copyright Act (17 U.S.C.).
Protected elements include, but are not limited to:
— The thematic navigation column system (Home, Beauty, Styles, Following, For You) enabling intuitive content organization;
— The vertical contextual action rail, adapted according to the usage context: shopping rail (Profile, Cart, Share, Menu) for the Home, Beauty and Styles columns, and social rail (Profile with "+" icon, Heart with counter, Comment with counter, Share with counter, Bookmark with counter, Overflow menu) for the Following and For You columns;
— The bottom navigation bar present in social columns (Following, For You) comprising the Explore, Cart, central "+", Headphones and Profile tabs, and absent in shopping columns to maximize video space;
— Innovative call-to-action (CTA) buttons, available in 12 distinct shapes (pill, rectangle, rounded rectangle, sharp-cornered rectangle, circular, ghost/outlined, notched, split 50/50, underlined text, CTA + overflow trigger, vertically stacked CTAs, rail-integrated CTA) and positioned in 7 ergonomic screen zones (bottom-center, bottom-left, bottom-right, top-center, mid-screen, rail-integrated, stacked);
— The dual cross-navigation system via swipe: horizontal swipe (left ⇄ right) to move between main columns, and vertical swipe (up ⇅ down) to explore immersive, unlimited content associated with an artist, brand or universe;
— The Live Shopping video interface with interactive product overlay (light gray rectangular card in the top-left zone), integrated live chat, catalog circle, and dual shopping access;
— The Full Artist Shop with hero banner, artist information section and product catalog in a 2-column grid with fully clickable cards;
— The Styles Landing Page (web version), with hero section, featured artist CTA and product grid with individual CTAs without the ">" arrow (web convention);
— The Artist Teaser advertising format with minimalist rail, sponsored badge, flat CTA without glow and external streaming redirect;
— The "For You" algorithmic feed with full social rail and bottom navigation bar;
— The lateral positioning of UX elements (left, center, right) and their mirror-effect functionality;
— The three lines of descriptive text positioned at the bottom left above the CTA;
— CTA visual variants: glow/soft elevation effect, flat treatment (advertising format), outline/ghost, bicolor split;
— The ">" arrow integrated to the right of the label in mobile application CTAs, and its absence in web version CTAs (website convention);
— The "Outfits PRIME" loyalty program with timed priority access and Premium badge.
2.3. Protected Interaction Protocols
The following interaction protocols constitute protected original creations:
— The full-screen overlay system with slide-up animation (rising from bottom to top at 100% of the screen), triggered by activation of navigation tabs (Styles, Beauty, Home) as well as by activation of purchase CTAs ("Shop Now");
— The automatic pausing of video content when the overlay opens in shopping columns (Home, Beauty, Styles), and automatic playback resumption upon closing;
— The slide-up animation of the Full Artist Shop from the bottom of the screen to 100% height, triggered by the "Shop Now" CTA;
— The fixed behavior of CTAs, always visible during scrolling (sticky positioning);
— The platform's self-sustaining viral cycle: clip → purchase → fan content → new purchase → visibility → streams.
2.4. Protected Labels and Wording
The following labels, associated with their specific graphical and functional context within the Outfits® platform, constitute protected elements:
— "Shop Now >": main purchase CTA on the mobile application;
— "Listen Now >" / "Écouter >": streaming redirect CTA in the Artist Teaser advertising format;
— "Shop Now" (without arrow): purchase CTA on the web version;
— "Add to Cart" / "Acheter": individual product CTAs in the web catalog grid;
— "Style it", "Try it on", "Place it": immersive action labels associated with a specific graphic code (dark gray buttons, white uppercase typography, rounded border);
— "Outfits PRIME": loyalty program with priority access;
— "Premium": exclusive content identification badge;
— Navigation column names: "Home", "Beauty", "Styles", "Suivi" (Following), "Pour Toi" (For You).
2.5. Prohibition of Copying and Exploitation
Any reproduction, imitation, extraction, modification, distribution or reuse for commercial or non-commercial purposes of all or part of the Website, without prior written authorization from the Founder, is strictly prohibited.
It is specifically prohibited to use the Website or its elements to train any artificial intelligence or algorithm for competitive purposes.
All designs, UX variants, navigation structures, interaction protocols, content, trademarks and graphic elements of this platform are the subject of official filings with EUIPO, INPI, U.S. Copyright Office, Copyright France, SGDL and Copyright Dépôt, and are protected by copyright law, EU Community design law, French design law, and trademark law.
Any reproduction, imitation, extraction, adaptation or exploitation, partial or total, by any means whatsoever and on any medium whatsoever, without prior written authorization, constitutes infringement and/or an act of unfair competition or free-riding (parasitisme).
Any violation will systematically be subject to civil and criminal proceedings.
The following are specifically prohibited:
— Copying the general UX structure, characterized by a vertical scroll (full-screen video format), a lateral arrangement of UX elements (left, center or right in mirror effect) and a vertical contextual action rail, without a formal legal agreement;
— Imitating the cross-navigation system between the "Home", "Beauty", "Styles", "Following" and "For You" columns via horizontal swipe, enabling fluid access between different universes;
— Reproducing the differentiating UX protocol based on a dual cross-navigation system via swipe (horizontal and vertical);
— Reproducing the positioning of CTAs in protected zones (bottom-center, bottom-left, bottom-right, top-center, mid-screen, rail-integrated, stacked) and their shapes (pill, rectangle, circular, ghost, notched, split, text, etc.);
— Reproducing the full-screen overlay system with slide-up animation and automatic video pausing;
— Reproducing the Live Shopping interface with product overlay, integrated chat and dual shopping access;
— Reproducing the Full Artist Shop with hero banner, artist information and product catalog in grid format;
— Reproducing the Styles Landing Page with featured artist CTA and product grid with individual CTAs;
— Reproducing the Artist Teaser advertising format with minimalist rail and streaming redirect;
— Reproducing the adaptive contextual rail system (shopping rail vs. social rail) according to the active navigation column;
— Reproducing the presence/absence logic of the bottom bar according to context (shopping vs. social);
— Any attempt at reverse symmetry (left → right or right → left) without UX disruption;
— Reverse engineering or any form of technical circumvention of the system;
— Reproducing all or substantial parts of the architectural elements, information hierarchy and graphic design present on the Website;
— Using Website elements to train artificial intelligence models or algorithms for reproduction or circumvention purposes.
2.6. Key Protection Elements
Official prior art filings: Outfits® benefits from reinforced legal protection through successive filings with EUIPO (35 registered designs), INPI (26 designs, Outfits® trademark in classes 9, 25, 35, 38 and 41, 13 e-Soleau envelopes), U.S. Copyright Office (3 registrations), Copyright France, SGDL and Copyright Dépôt (29 filings), attesting to the prior art and protection of its immersive UX and its visual and functional variations.
Design space saturation: the 35 EUIPO designs cover the entire commercially viable design space for a mobile music video-commerce platform, including 7 positioning zones, 12 CTA shapes, 10 usage contexts, 6 rail configurations, 4 navigation patterns and 2 web interfaces. Any attempt at circumvention through modification of CTA positioning, shapes or usage context will fall within the scope of protection of one or more of the filed designs.
Exclusive aesthetic codification: the visual identity of Outfits®, characterized by a mobile-first design, vertical scroll, lateral contextual action rails, cross-swipe navigation and soft elevation CTAs (glow), is protected and may not be reproduced without authorization.
Locked immersive UX structure: the overall architecture of Outfits®, combining vertical scroll, cross-navigation, lateral action elements, full-screen overlays with video pausing and a self-sustaining viral cycle, is protected as an innovative system. The elements of this architecture are inseparable from the project and require the Founder's consent to be used.
Article 3: Use of the Website
3.1. Authorized Use
The User is authorized to freely browse the Website, in compliance with these Terms of Use and applicable legislation.
3.2. Restricted Use
Any attempt to misuse the Website's content, particularly for purposes of commercial free-riding, misappropriation, disparagement or creation of a competing activity, is strictly prohibited.
It is specifically prohibited to use robots, scrapers or any other automated tool to collect data from the Website, as well as any attempt to partially or fully reproduce the code.
3.3. Non-Solicitation
Any person who has had access to confidential elements of the Website (collaborators, service providers, partners) is prohibited from contacting or diverting the Founder's contacts, from developing a similar project, and from any reproduction of information present on the Website.
Article 4: Liability
4.1. Limitation of Liability
The Founder disclaims all liability in the event of service interruption, bugs or technical difficulties affecting the Website.
4.2. External Links
Links to third-party websites are provided for informational purposes only. Their content is not the responsibility of the Founder.

The Website does not collect any identifiable personal data.

Article 7: Amendments to Terms of Use
These Terms of Use may be amended at any time. Updated versions are published directly on the Website and are immediately applicable.
Article 8: Applicable Law
These Terms of Use are governed by French law. Any dispute shall fall under the exclusive jurisdiction of French courts.
Without prejudice to the foregoing, the Founder reserves the right to bring proceedings before any competent court, including the Community Design Courts of the European Union (in accordance with Council Regulation (EC) No 6/2002) and the United States Federal Courts (in accordance with 17 U.S.C. and 15 U.S.C.).
Article 9: Mediation
In the event of a dispute relating to the interpretation or performance of these Terms of Use, the User is invited to contact the Founder first to seek an amicable resolution.
Failing an amicable resolution, the User may resort to mediation.
Article 10: Sanctions for Violations
In the event of a confirmed violation of these Terms of Use, the Founder reserves the right:
— To initiate any judicial proceedings, civil and/or criminal, in France, in the European Union and internationally, notably for design infringement (articles L. 521-1 et seq. of the French Intellectual Property Code; articles 80 et seq. of Regulation (EC) No 6/2002), copyright infringement (articles L. 335-2 et seq. of the French IPC; 17 U.S.C. § 501 et seq.), trademark infringement (articles L. 716-4 et seq. of the French IPC; 15 U.S.C. § 1114), unfair competition and free-riding (articles 1240 and 1241 of the French Civil Code);
— To demand the immediate removal of infringing content on any medium (website, application, social network, marketplace, etc.);
— To seek full compensation for damages suffered, including damages calculated on the basis of lost profits, moral prejudice and reputational harm, reimbursement of legal and attorney fees, and statutory damages as provided under U.S. law (17 U.S.C. § 504(c)(2) — up to USD 150,000 per work in case of willful infringement);
— To seek any emergency measures (injunctions, blocking orders, seizure of infringing goods, penalty payments) to stop the violation;
— To report the violation to competent authorities (EUIPO, INPI, U.S. Copyright Office, DMCA platforms, European Union customs authorities in accordance with Regulation (EU) No 608/2013) and relevant hosting providers.
Any attempt at technical circumvention (reverse engineering, modification of UX layout, AI training, adaptation of labels or graphic codes, etc.) shall be treated as infringement and prosecuted accordingly.
Failure to comply with these Terms of Use exposes the offender to civil and criminal penalties, as well as publication of the court decision at the offender's expense.
The interfaces, UX designs and visual elements of Outfits® are protected by French copyright law, EU Community design law (EUIPO), French design law (INPI) and the U.S. Copyright Act (U.S. Copyright Office).
Any use, reproduction or imitation without prior written authorization constitutes infringement and exposes the perpetrator to civil and criminal proceedings.
